Terms of Service, Privacy Policy, Creator Addendum, and Content Policy for vFAPS. By accessing or using the Service, you agree to these terms.
You must be at least eighteen (18) years of age to use vFAPS. By using the Service, you represent and warrant that you are 18 or older, have the legal capacity to enter into binding agreements, and are not prohibited from using the Service. vFAPS reserves the right to request age verification where legally required.
vFAPS provides a digital platform for browsing, uploading, selling, rating, and downloading funscript files. The Service may integrate with third-party hardware devices but does not manufacture or control such devices.
The Service is intended for adults. Content involving minors, non-consensual acts, exploitative material, or unlawful sexual content is strictly prohibited. vFAPS maintains zero tolerance for illegal content and reserves the right to report violations to law enforcement.
Users must provide accurate information and maintain account security. Users are responsible for all activity under their account. vFAPS may suspend or terminate accounts at its sole discretion for violations.
Users retain ownership of uploaded content but grant vFAPS a perpetual, worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, distribute, display, analyze, and process such content for purposes of operating, improving, and promoting the Service.
vFAPS may use uploaded content, including scripts and metadata, in anonymized or aggregated form to develop, train, test, evaluate, and improve machine learning and artificial intelligence systems. This includes recommendation systems, moderation tools, analytics systems, and generative tools. Ownership of original intellectual property remains with the user.
Creators set their own pricing. vFAPS retains a 6.9% platform fee plus payment processor fees, currency conversion fees, and transaction costs. Fees may be updated with reasonable notice.
All sales are final. Refunds may be issued solely at the discretion of vFAPS. Refunded transactions may result in revoked access.
In the event of chargebacks or payment reversals, vFAPS may deduct disputed amounts and related fees from Creator payouts and may withhold funds to mitigate risk.
Scripts may interact with third-party hardware. vFAPS does not guarantee safety, compatibility, or performance. Use is at the user's own risk. Users voluntarily assume all risks associated with hardware interaction.
vFAPS complies with the Digital Millennium Copyright Act (DMCA). DMCA notices must include identification of the copyrighted work, location of infringing material, contact details, a good-faith statement, and signature. Counter-notices must comply with federal requirements.
Before filing claims, users agree to attempt informal resolution within 30 days. Disputes shall be resolved through binding arbitration in Illinois, administered by a recognized arbitration provider. Users waive jury trial and class action rights.
To the maximum extent permitted by law, vFAPS shall not be liable for indirect or consequential damages. Total aggregate liability shall not exceed the greater of amounts paid in the preceding 12 months or $100.
Users agree to indemnify and hold harmless vFAPS from claims arising from uploaded content, misuse, or violation of Terms.
These Terms are governed by the laws of the State of Illinois. vFAPS reserves the right to designate alternative jurisdiction if legally required.
Email address, password hash, display name, IP address, usage logs, purchase history, and script metadata. Identity verification may be handled by payment processors.
Information is used to provide services, process payments, prevent fraud, enforce policies, train AI systems, and comply with legal obligations.
Data may be shared with payment processors, hosting providers, or legal authorities as required. vFAPS does not sell personal data.
Data is retained as necessary for operational, legal, and dispute resolution purposes.
Users may request deletion, access, or correction of data by contacting legal@vfaps.com.
Creators receive gross sale price minus 6.9% platform fee and payment-related fees.
Creators must complete identity verification required by payment processors and are responsible for taxes.
Disputed transactions and associated fees may be deducted from payouts.
Creators warrant legal ownership and compliance with all applicable laws.
vFAPS may remove content, users, creators, or suspend monetization privileges at its discretion.
Content involving minors, non-consensual acts, illegal material, malware, or copyright infringement is prohibited.
Users must have rights to distribute content. Repeat infringement results in permanent suspension.
Fraud, rating manipulation, pirated uploads, or payment circumvention is prohibited.
Scripts must not attempt to damage hardware or contain malicious code.
vFAPS may remove content, suspend accounts, or report violations.
